Introduction:

24up. (“24up.”, “we”, “us”, “our”) provides access to the 24up. platform, including the website, APIs, and domain registration services (“Services”). By using the Services, you agree to be bound by these Terms of Service (“Agreement”). If you are using the Services on behalf of a company, you must have the authority to bind that company to this Agreement.

Age and Eligibility:

You must be at least 16 years old to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Your Content:

You are responsible for the content you upload to the Services. By posting content, you grant 24up. a license to use, modify, and distribute your content in connection with the Services. 24up. can remove content at any time.

Free Plan:

24up. offers a free plan but may change the terms or discontinue it at any time. Projects on the free plan may be removed without notice.

Fair Use:

24up. will provide reasonable bandwidth and storage for all plan levels but may shut down projects or accounts that create an unreasonable burden on infrastructure.

Acceptable Use:

The Services must be used lawfully. You must not undermine security, gain unauthorized access, send unsolicited messages, or misuse the Services.

Security:

24up. takes measures to protect your content but is not liable for unauthorized access or data loss.

Usage Restrictions:

You may not sublicense, reverse engineer, or commercially exploit the Services. You must comply with all laws and 24up. policies.

Electronic Communications:

By using the Services, you consent to receiving electronic communications from 24up..

Representations and Warranties:

You represent that you own or have the necessary rights to your content and that your use of the Services complies with laws and 24up. policies.

Indemnification:

You agree to indemnify 24up. against any claims arising from your use of the Services or your content.

Confidentiality:

Both parties will protect each other’s confidential information and use it only for purposes related to the Services.

Payment of Fees:

Services are provided according to the plan level you select. Fees are charged in advance for subscriptions and annually for domain registrations. All fees are non-refundable.

Term and Termination:

This Agreement continues as long as Services are provided. Either party can terminate the Agreement with notice. Upon termination, your content may be deleted.

Disclaimer:

The Services are provided “as is” without warranties of any kind.

Limitation of Liability:

24up.’s liability is limited to the greater of $100 or the fees paid by you in the six months prior to the act giving rise to liability. Certain limitations may not apply in some states.

Miscellaneous:

24up. may change these Terms with 30 days’ notice. If any provision is unenforceable, it will be limited to the minimum extent necessary. This Agreement is the complete statement of understanding between the parties.

Governing Law and Disputes:

This Agreement is governed by the laws of Florida. Disputes will be resolved by binding arbitration, not in court, except for certain intellectual property disputes. There is a class action waiver.

Privacy:

Translation Interpretation:

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions:

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
